After nearly a decade of regulatory review and litigation, Shear Development Company secured a landmark victory that cleared the way for the development of three single-family homes in Los Osos, California. The California Supreme Court ultimately ruled in favor of Shear and San Luis Obispo County, bringing long-awaited certainty to the project and establishing an important precedent for coastal permitting throughout California.
The project required persistence from an experienced team that included the property owner, land use consultants, legal counsel, and public agency staff. At the center of the dispute was whether the California Coastal Commission could assert appellate jurisdiction over a Coastal Development Permit that had been lawfully approved by San Luis Obispo County. Represented by the Pacific Legal Foundation, Shear successfully argued in Shear Development Co., LLC v. California Coastal Commission that the Commission’s authority must be exercised within the limits established by law. The Court’s decision reaffirmed the role of local governments in administering coastal development permits and clarified that the courts—not administrative agencies—have the final responsibility for interpreting land-use statutes. The ruling not only enabled construction of the approved homes to proceed but also provided greater certainty for property owners, developers, and public agencies working within California’s coastal zone. As both a project success and a significant legal milestone, the case demonstrates the value of collaboration, persistence, and strategic advocacy in navigating California’s challenging land-use environment.
